Terms of Service

These Terms of Service ("Terms") govern your access to and use of Stillwing (the "Service"), operated by Benjamin Antoniades ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you do not have permission to access the Service.

1. Acceptance of Terms

By accessing and using stillwing.app or any related services, you accept and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

2. Description of Service

Stillwing is currently in pre-launch development. We are collecting waitlist signups and conducting research to inform the development of a future application designed to help nervous flyers manage anxiety related to commercial flights through information and notifications about turbulence and other in-flight phenomena.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age and that you have the legal capacity to enter into these Terms.

4. User Accounts and Waitlist

By signing up for our waitlist, you agree to provide accurate information and to receive communications from us related to the development and launch of Stillwing. You may unsubscribe from these communications at any time.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Benjamin Antoniades. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

6. User Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any portion of the Service
• Interfere with or disrupt the Service or servers connected to the Service
• Submit false, misleading, or harmful information
• Impersonate any person or entity
• Use automated means to access the Service without our express written permission

7. Disclaimers

The Service is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding the operation or availability of the Service or the information, content, or materials included therein.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Any future information provided by Stillwing regarding turbulence, flight conditions, or in-flight phenomena is informational and intended to help users understand normal aspects of commercial aviation. Such information should not be relied upon for any safety-critical decision-making, and is not a substitute for guidance from licensed aviation professionals or medical/mental health providers.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Benjamin Antoniades, its affiliates, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of, or inability to access or use, the Service.

9. Indemnification

You agree to defend, indemnify, and hold harmless Benjamin Antoniades and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the Service or your violation of these Terms.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved in the courts located in Maricopa County, Arizona.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
